11. General Provisions. The Terms of Service and the relationship between you and GreenTech shall be governed by the laws of the State of Virginia without regard to its conflict of law provisions. Any and all disputes arising from or in connection with the GreenTech Site shall be subject to binding arbitration conducted by a single arbitrator in Richmond, Virginia pursuant to the Commercial Arbitration Rules of the American Arbitration Association, as now or hereafter amended; provided, however, that GreenTech shall be entitled to seek injunctive and other equitable relief in any forum of competent jurisdiction to enforce these Access Terms of Service or its rights in the GreenTech Site and its Content without first seeking or obtaining any decision in arbitration. No failure or delay of GreenTech to exercise or enforce any right or remedy under these Access Terms of Service shall constitute a waiver thereof. If any provision of these Access Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Access Terms of Service remain in full force and effect.
